Terms and Conditions

1. The “Star Chat Service” (“Service”) is open only to Indian citizens (individuals) residing in India who are valid prepaid or postpaid subscribers of Tata Indicom.
2. This Service is provided by Tata Teleservices Limited (TTL) and is subject to the laws of India.
3. Subscribers of TTL subscribing to the Service may get a chance to chat with the celebrity of their choice through this Service.
4. Subscriber need to dial 566949 short code to activate the Service.
5. Subscribers shall be intimated by TTL about the Star Chat service through OBD, SMS & on IVR as and when the celebrity is available to Chat with the subscribers for a predefined period.
6. Calls made by the subscriber will be patched and the subscriber may get the chance to chat with the celebrity subject to the selection of subscriber based on the queue of callers awaiting for connection of call with the celebrity.
7. Time limit for chatting with the celebrity will be pre-defined for each call.
8. All calls on the short code will be charged at Rs.1.50/minute & a monthly subscription for subscribing to the service shall be Rs.30/- per month for TATA Indicom subscribers.
9. A successful chat session with a celebrity will be subject to following conditions:
   a) Login status of the celebrity
   b) Busy status of the celebrity
   c) Number of subscribers in queue waiting to chat with the celebrity
   d) Number of subscribers opting out of the queue relating to chatting with the celebrity
10. The subscriber can opt for online Voice Chat Service if the subscriber does not intend to continue waiting in the queue of subscribers for his/her opportunity to talk to the Celebrity. Subscriber opting for Voice Chat, need to select and dial the Del. No. of his/her choice and if Voice Chat service is activated on such Del.No. chosen by the subscriber, then call made by the subscriber shall be patched to such Del.No. chosen by the subscriber and subscriber will be able to avail Voice Chat Service.
11. For auditing & promotional activities, TTL may record the subscriber’s chat with the celebrity, randomly.
12. By using the Service the subscriber agree not to use, speak, communicate or otherwise transmit any matter or views, which are, defamatory, abusive, pervasive, obscene, invasive of another's privacy, hateful, or racially, ethnically or otherwise objectionable.
13. By using the Services the subscriber agree not to indulge or create a nuisance for any Celebrity or TTL.
14. TTL merely endeavours to provide a platform where subscribers of TTL and celebrity may interact, exchange information, views, thought, opinion. TTL does not have any involvement in the actual interaction between the subscriber and celebrity in any way. It is only the subscriber, who is entirely responsible for all the conversation, talk, interaction, discussion, chat between itself and the celebrity arising out of the Service. TTL will not be liable for any loss that subscriber may incur, due to any representation, assurance, statement made by the Celebrity to the subscriber in the course of the chat between the subscriber and celebrity by using the Service.
15. TTL shall not be liable for any failure to comply with its obligations in providing the Service, caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, acts of god or any other circumstances amounting to Force Majeure.
16. The aggregate liability of TTL, in case of any damage, loss, cost, claim, liability or expense (including legal costs and expenses) caused to or incurred by any act, omission or representation in respect of the Service to any subscriber, shall not exceed the total value paid by the subscriber for availing the Service.
17. TTL reserves the right to terminate, modify or extend this Service at any time at its absolute discretion and may inform the subscriber of such termination, modification, extension of service by publishing notice on Tata Indicom website.
18. TTL shall not be responsible for any loss or damage if it has to discontinue or cancel this Service in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The subscriber may be informed of such discontinuance/cancellation as soon as possible, through the Tata Indicom website.
19. The subscription to this Service implies acceptance of all the terms and conditions of the Service.
20. The decision of TTL as to the interpretation of any of these terms and conditions and governing this Service, shall be final and binding on the subscribers subscribing to this Service. TTL shall entertain no dispute in this respect.
21. Any disputes with regard to the Service will be subject only to the jurisdiction of the courts in New Delhi.
22. If any provision of these Terms and Conditions is found to be invalid by any court having competent jurisdiction the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms and Conditions, which shall remain in full force and effect.
23. Subscription to the service will not itself make the subscriber eligible to chat with Bollywood star.
24. TTL shall not be responsible if the subscriber is unable to chat with the celebrity due to network failure, network congestion, network unavailability or any such technical issues faced by the subscriber.
25. Subscriber agree to follow all applicable laws and regulations in the process of using the Service. Subscriber agree not to indulge in the following prohibited activities:
    Subscriber shall not express, transmit, update or share any information on the Chat, that:
    (i) belongs to another person and to which Subscriber do not have any right to;
    (ii) is grossly harmful, harassing, blasphemous, defamatory, obscene, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging unlawful activity in any manner whatever;
    (iii) infringes any patent, trademark, copyright or other proprietary rights;
    (iv) violates any law for the time being in force;
    (v) deceives or misleads TTL or celebrity or communicates any information which is grossly offensive or menacing in nature;
    (vi) impersonate another person;
    (vii) threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order or causes incitement to the commission of any cognizable offence or prevents investigation of any offence or is insulting any other nation.
26. TTL reserves its right to refuse service, restrict, suspend, terminate subscriber’s account at any time in its sole discretion with or without any prior notice for any violation of the Terms and Conditions of the Service by the subscriber. Upon such termination or suspension, subscriber’s right to use the Service will immediately cease.
