Terms and Conditions

  1. To participate in the Contest, dial <12999>.
  2. The Contest is open only to Indian citizens (individuals) residing in India aged 18 years or above, who are valid subscribers of Tata Teleservices Ltd in Gujarat Telecom circle (hereinafter collectively referred to as “TTL”).
  3. The Contest is not open for employees, distributors, franchisees, agents and suppliers of TTL and Siddhivinayak Astrology Services Pvt. Ltd. (“SASPL”) and also for the relatives of such employees, distributors, franchisees, agents, vendors and suppliers.
  4. The Contest shall start from 14/07/2011 and will continue till 28/07/2011 (hereinafter referred as “Contest Period”).
  5. The Contest is valid in Gujarat Telecom circle.
  6. The Contest shall be in the form of 5 questions relating to Astrology to be correctly answered by the subscriber. Three Subscribers correctly answering to all 5 questions at the earliest point in time collectively, will be the winner of the Contest and will be entitles to the Contest Prize comprising of Gemstones. For eg. If Mr. X took 5 minutes to answer 1st question, 6 minutes to answer 2nd question, 7 minutes to answer 3rd question, 8 minutes to answer 4th question, 2 minutes to answer 5th question, the total time taken by Mr X to answer all the questions collectively will be 28 minutes (5+6+7+8+2 minutes).
  7. The Contest will start from 00.01 hr of 14/07/2011  and shall be open till 0000 hrs in night of 14/07/2011  
  8. The Contest Prize to the subscribers is in the interest of the subscribers. Since service is a premium service, the call charges for prepaid & postpaid subscribers on short code 12999 shall be Rs 6 per minute. The charges paid by the subscribers are towards the service and no additional charge will be collected from the subscribers for participating in the Contest.
  9. The Contest is organized by TTL only for their subscribers in Gujarat telecom circle and is managed by SASPL. The subscribers understand that the Contest Prize under the Contest are provided by SASPL and TTL shall not be responsible for non-delivery or shortfall or deficiency in Contest Prize and all the legal remedies in relation to the Contest Prize solely lie against SASPL.
  10. case there are two or more subscribers submitting correct answer to the questions at the same point in time, then the winner of the Contest Prize will be the subscriber who has answered maximum questions at the earliest point in time amongst the two or more subscribers as per the records of TTL. The decision of TTL in choosing the winner of the Contest shall be final and binding on the subscribers of the Contest. TTL shall not entertain any dispute in this respect.
  11. The winner/s shall be intimated within 45 days of conclusion of Contest by SASPL by way of telephonic call and SMS, on confirmation of the list of winners by TTL.
  12. In the event of no response from the concerned winner to the telephonic call or SMS within 10 days, he will be intimated through a registered post. If the concerned winner does not respond to the registered post communication within 10 days of the receipt of the post or if the registered post returns undelivered then his Contest Prize will be forfeited.
  13. The Contest Prize will be distributed within 10 days from the acknowledgement of the acceptance of the Contest Prize by the concerned winner in response to the communication from SASPL.
  14. If the winner absents from taking the delivery of the Contest Prize and fails to collect the same from SASPL within 20 days from the acknowledgement of the acceptance of the Contest Prize by him, then his Contest prize stands forfeited.
  15. The Contest prize will be distributed and delivered by SASPL through courier at the address of the winner, as appearing in the records of TTL. The Logistics and cost of delivering the Contest Prize will be borne by SASPL. It is the responsibility of the subscriber to inform TTL of any change in the address of communication, as appearing in the records of TTL. In the event of the winner responding that he/she has changed the address of communication, the winner should submit proof of address change to TTL for the proper delivery of Contest prize.
  16. Contest Prizes are non-endorsable, not transferable and non-substitutable.
  17. TTL will entertain no requests for exchange in lieu of the Contest Prize.
  18. The Contest Prize for the Contest will be given only to the winner/s in whose name the mobile phone number is registered. The winner needs to be the TTL active subscriber at the time of receipt of Contest Prize and winner should have cleared all the outstanding dues of TTL.
  19. Apart from the entitlement to the above Contest Prizes, the winner/s or their legal heirs will have no other rights or claims against TTL or SASPL.
  20.  TTL reserves the right to terminate, modify or extend this Contest at any time at its absolute discretion, with notice to the participants for any such termination, modification or extension of the Contest provided on the TATA Indicom website.
  21. The Contest cannot be clubbed with any other Contest.
  22. The Contest Prizes shall be subject to the laws of India, including all the tax laws. All applicable regulatory and statutory duties, cess, surcharges, taxes (including TDS), insurances, transfer fees, registration fees etc. that may be applicable to avail/use the Contest Prizes will be borne exclusively by the winner.
  23. TTL shall not be liable for any failure to comply with its obligations caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, inevitable accidents, acts of god or any other circumstances amounting to Force Majeure.
  24. TTL shall not be responsible for any loss or damage if it has to discontinue or cancel this Contest in compliance with any law, ruling, order, circulars, notifications, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The participants shall be informed of such discontinuance/cancellation as soon as possible, through the Tata Indicom website.
  25. Delivery of question to the subscriber is conditional to TTL’s technical infrastructure and network uptime. TTL shall not be responsible if the subscriber is unable to participate in the Contest due to network failure, network congestion, network unavailability or any such technical issues faced by the subscriber.
  26.  The participation in this Contest implies acceptance of all the terms and conditions of the Contest by the subscriber participating in the Contest.
  27. The decision of TTL as to the interpretation of any of these terms and conditions shall be final and binding on the subscribers.
  28. Any disputes with regard to the Contest, will be subject only to the jurisdiction of the courts in Ahmedabad, Gujarat.
  29. The aggregate liability of TTL, in case of any damage, loss, cost, claim, liability or expense (including legal costs and expenses) caused to or incurred by any act, omission or representation in respect of the Contest Prizes of this Contest to any individual winner, shall not exceed the value of Contest Prize.
  30. shall not be responsible for any loss or damage if it has to discontinue or cancel this Contest in compliance with any law, ruling, order, regulation, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control.   31.  Contest Prizes may be subject to variation at the discretion of SASPL. In the event it is necessary to vary the Contest Prize offered, SASPL shall offer the winner a prize of a similar description or value where possible. TTL reserves the right to disqualify any subscriber and/or winner in its sole discretion.
  32.  If any provision of these terms and conditions is found to be invalid by any court having competent jurisdiction the invalidity of such provision shall not affect the validity of the remaining provisions of these terms and conditions, which shall remain in full force and effect.
  33. The participation in this Contest implies unconditional acceptance of all the terms and conditions of the Contest by the subscribers.

  2. The Offer is open only to Indian citizens (individuals) residing in India aged 18 years or above, who are valid prepaid and postpaid subscribers of Tata Teleservices (Maharashtra) Limited (TTML) eligible to enter into a contract (hereinafter referred to as “Participant/s”).
  3. The Offer is not open for employees, distributors, franchisees, agents and suppliers of TTML and Ganesha Speak and also the relatives of such persons.
  4.  The Offer shall run for the period of 31 days (i.e. from 18th July 2011 17ht August 2011) (“Offer Duration”)
  5.  The Offer is valid only in the telecom circle Mumbai & MH.
  6. The Offer consists of Participant/s using VAS services made available on the 12999, wherein caller can avail the services of talk to Bejan Daruwalla’s team of astrologer and seek answers on their queries. Three Participants using maximum usage of said VAS services and answers to the question correctly at the earliest point in time as per the records of TTML will be the winner of the Offer and will get to gratification in form of Birthstones.
  7.  The gratification is in the interest of the subscribers. The charges paid by the Participant/s for availing services of Live Astrology (dial 12999) and no additional charges are collected from the Participant/s for the Offer.
  8. The gratification is sponsored by Vendor Ganesha Speak. The Participants understands that the gratification under the Offer is provided by Ganesha Speak and TTML will not entertain any claims in this regard and all the legal remedies with respect to gratification shall lie solely against Ganesha Speak.
  9.  The decision of TTML shall be final and binding on the Participants of the Offer. TTML shall entertain no dispute in this respect.
  10.  There will not be any assured gift to the Participants for participating in the Offer.
  11.  The winner will be intimated within 1 day of conclusion of Offer by Ganesha Speak by way of telecalling, on confirmation of the list of winner by TTML. In the event of no response from the concerned winner to the phone call within 5 day of receiving the tele-call, he will be intimated through registered post. If the concerned winner does not respond to the registered post communication within 10 days of the receipt of the post or if the registered post returns undelivered, then his gratification will be forfeited and TTML reserves the right to offer the gratification to the Participant who has answered the question correctly at the earliest in point of time as per the records of TTML, subsequent to the earlier selected winner of the Offer.
  12.  The list of the winners will be posted on the Tata Indicom website.
  13.  The final details, including gratification, venue, date to handover the gratification will be communicated on a short notice to the winner. The travel cost for claiming gratification  will be borne by the concerned winner/s.
  14.  The gratification is non-endorsable, non- transferable and non-substitutable. The gratification can be redeemed only once.
  15.  The gratification can be offered only to the winner in whose name the mobile phone number is registered. The winner needs to be TTML active subscriber at the time of redeeming the gratification and winner should have cleared all the outstanding dues of TTML.
  16.  Apart from the entitlement to the above gratification, the winner or his legal heirs will have no other rights or claims against Ganesha Speak or TTML.
  17.  To process the claim of Gratification, the winner should declare his name, address, age,  proof of identity and proof of payment of last due and outstanding mobile phone number bill to TTML
